Many letting agents are misleading landlords by informing them that a landlord must provide a Legionella testing certificate before they can rent out their property. In reality this is not true.

A risk assessment is a full assessment of the building and its water systems along with anything else that could cause a potential source of Legionella. This is to assess the likelihood of an outbreak and to put in place control measures that will mitigate any risks to employees, tenants or other visitors.

The assessment process consists of two parts, a physical inspection and an examination of the building’s records and management processes. A qualified risk assessor should be able to carry out this evaluation and recommend control measures. However, it is the responsibility of the building owner or facility manager to implement and maintain these control measures.

Typically, a risk assessment will include a review of the water system including cold and hot water systems and any cooling towers. The water samples will then be tested for the presence of legionella. Once the results have been received the assessor will use the information gathered to determine the level of risk and establish appropriate control measures. This will be outlined in a written report. The report should also outline a monitoring and review program.
